Terms and Conditions for Christmas Lighting Installations
Deposit and Payment Terms
- A 50% deposit is required at the time of scheduling your Christmas lighting installation.
- The remaining 50% is due at the time of installation.
- The total amount for materials (lighting and accessories), installation, and removal must be paid in full upon completion of the installation.
Liability
- Wheatley Creek Services is not responsible for any products damaged or lost due to vandalism, extreme weather conditions, or acts of God.
- We will make efforts to replace any damaged products for an additional charge. No warranty or complimentary repair service is expressed or implied unless specified in writing in this agreement.
- Wheatley Creek Services will replace any malfunctioning products but does not guarantee that each individual bulb will remain lit for the entire installation period.
Cancellations
- By agreeing to this quote, the customer acknowledges that Wheatley Creek Services fills its schedule well in advance.
- All cancellations will be charged 50% of the labor charge.
Power Supply
- All bids are made under the assumption that adequate power supplies and receptacles are available.
- The customer is responsible for maintaining and providing adequate electrical outlets adjacent to the proposed locations for lit decorations and building lights.
Governing Law and Dispute Resolution
- This contract is governed by the laws of the State of Colorado and constitutes the entire agreement between the parties.
- If a dispute arises out of this contract, the parties agree to resolve the dispute through arbitration in Grand County, Colorado, before a single arbitrator.
- Any judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
- The prevailing party in arbitration shall be entitled to reasonable attorney’s fees and costs.
Acceptance
- By approving this quote, you agree to the terms of this contract and accept this proposal under those terms.
- You also declare that you are authorized to sign this document, either as the property owner or as an agent for the owner or entity.
Interest on Late Payments
- Any amount not paid when due will bear interest from the due date until paid at a rate equal to 35% per month or the maximum allowed by law, whichever is less.
